1. Acceptance of Terms
Agreement
By accessing or using any NexGenium service — including our website, training programs, software development services, and cloud consulting — you confirm that you have read, understood, and agree to be bound by these Terms of Service.
Amendments
NexGenium may revise these terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the revised terms. We recommend reviewing this page periodically.
2. Our Services
Training & Education
NexGenium provides professional technology training, masterclasses, and certification-preparation courses in areas including DevOps, Cloud Engineering, Full-Stack Development, React, Node.js, and more. Course content and curriculum are subject to change.
Software Development
We provide custom software development, web application engineering, API integration, and cloud migration services to businesses and enterprises. Specific deliverables, timelines, and scope are governed by individual project agreements.
Cloud & DevOps Consulting
Our consulting services include cloud architecture design, CI/CD pipeline implementation, infrastructure-as-code, and DevSecOps advisory. Scope of work is defined in a separate Statement of Work (SOW) for each engagement.
3. User Obligations
Accurate Information
You agree to provide accurate, current, and complete information when submitting forms, registering for courses, or engaging our services. Misrepresentation of identity or credentials is grounds for immediate termination of service.
Prohibited Conduct
You agree not to: (a) use our platform to transmit harmful, unlawful, or infringing content; (b) attempt to gain unauthorized access to our systems; (c) reverse-engineer or reproduce proprietary course materials; (d) engage in academic dishonesty in certification programs.
Account Security
Where you are issued credentials to access learning materials or client portals, you are responsible for maintaining the confidentiality of those credentials. Notify us immediately of any suspected unauthorized use.
4. Intellectual Property
NexGenium Content
All course materials, videos, documentation, source code samples, and brand assets produced by NexGenium are protected under applicable copyright, trademark, and intellectual property laws. Unauthorized reproduction is strictly prohibited.
License to Users
Upon enrollment, NexGenium grants you a limited, non-exclusive, non-transferable license to access and consume course content for your personal professional development only. This license does not permit redistribution or commercial use.
Client Project IP
For software development engagements, intellectual property ownership of final deliverables is governed by the respective project contract. Unless otherwise agreed in writing, code produced exclusively for a client becomes the client's property upon full payment.
5. Pricing & Engagement
Custom Pricing Model
NexGenium does not publish fixed or standardised pricing on its website. All service fees — including corporate training programs, software development projects, and cloud consulting engagements — are determined on a custom, project-by-project basis. To receive a tailored quote, please contact us directly via the inquiry form on our website.
Quotation & Agreement
A formal price proposal will be shared upon understanding your specific requirements, scope of work, and timelines. Engagement does not commence until both parties have agreed upon the terms and a written confirmation or contract has been exchanged.
Refund Policy
Refund eligibility depends on the nature of the service engaged and how far the engagement has progressed. For training, refund requests are reviewed on a case-by-case basis and must be submitted to [email protected] within 7 days of enrollment. For software development retainers, fees are non-refundable once active sprint work has commenced. All refund decisions are final.
6. Limitation of Liability
No Warranty
NexGenium services are provided "as is" and "as available." We make no warranties, express or implied, regarding the completeness, accuracy, reliability, or fitness for a particular purpose of our training content or software deliverables.
Liability Cap
To the maximum extent permitted by law, NexGenium's total liability in connection with any claim arising out of these Terms shall not exceed the amount paid by you for the specific service giving rise to the claim, in the 3 months prior to the claim.
Indirect Damages
NexGenium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, data, or business opportunities, even if advised of such possibility.
7. Governing Law
Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Uttarakhand, India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Dehradun, Uttarakhand.
Dispute Resolution
Before pursuing formal legal action, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days. If unresolved, disputes shall be submitted to binding arbitration under applicable Indian arbitration law.
